Dont let them steal your stuff! some of you need to re read his post.
I still say it doesn't matter what should be done or what the law says, if those cops were going to return your property you would have it back. They know your not going to pay the cost of getting a judge to force them to give it back, if it was ever even logged in as evidence, which I doubt. So a deputy or the sheriff decided to keep it. There are 10,000 stories of people around here who have lost property to law enforcement. I hate a thief.

Catch22, since your asking if there is a fee to file a motion I can only assume you don't know how either. what if you figure it out and then have to prove they took that property and prove it was your property. it aint gonna happen. those officers know what can and what will be done. You would be right danny, I don't know how or how much it would cost. Just hate to see people get their belonging stole from the same people who are supposed to apprehend thieves. Exactly Right!!!

The man was found not guilty. I guess law enforcement can just do whatever they want. You might think a differently if it was your stuff. Sometimes it seems law enforcement is not held to the same standard as everybody else.

I would forget about the stuff. You were found not guilty be happy with that. Rile up the Sheriff and you may get a lot of "speeding tickets", guilty or not. Bullspit!. That would be a sherrif with an agenda!

If somebody has my property without a legal reason and won't give it back that fits my definition of a thief. I wouldn't just suck it up. I would fight to get my stuff back.

If your talking to me it obviously is legal to do what I did as long as no weapons are brought onto that private property. It's in the hunting regulations and I brought them to my court trial and the judge even agreed with it. The county attorney didn't know what to say when I brought it up in court he was all flustered after that.

I'm sure the rules vary by State. Several years ago a game warden in Washington State took some stuff (knives and an ax) from a friend of mine who was a hound hunter, the cop told my friend they were going to investigate him for supposedly hound hunting bears (it had been banned in WA State).
Nothing ever came of it, it was just harassment imo. Anyway, my friend asked for his stuff back, they told him that since he hadn't filed some sort of form within 15 days of the seizure, he had forfeited it and wasn't going to get it back.
This is common practice, of course they know that nobody knows these rules, and they sure don't inform you of these rules that allow law enforcement to steal stuff from unsuspecting guys. I'm guessing your stuff is now being used by the sheriff deputy or his brother in law.

I'd make every effort to contact the judge who found you not guilty. Sounds like contempt of court to me. The judge might think so, too. Yep 55 cents and a letter to the Judge might fit the whole thing, the case is settled and property has not been returned what you got to lose!

I will be talking to the judge in the morning. He was out when I called today and his secretary at his law office said to call about 10am in the morning to talk to him.
