I got a trespassing while deer hunting charge back in December while out hunting with my wife. I was the one that got charged,I admitted I trespassed but we were tracking a wounded deer which is legal as long as you don't take a weapon on to the private property. I never said what we were doing I just admitted it so I got charged. Had a plea hearing in January and pleaded not guilty then had my trial the end of February, judge didn't rule that day I got a letter in the mail a couple weeks later were I was found not guilty. We went from the road across the land I got charged with then onto state land that over looked a river bottom and glassed with binos,the state land is no hunting also, when on state land I took out my folding chair and roll up blind out of my back pack and laid them down to get binoculars out we then glassed a few places overlooking the bottom and forgot my blind and chair when we left. The sheriff followed the tracks in the snow and found my stuff and he took those. So after I was found not guilty I asked for my stuff back and they went give them back. It was me with no lawyer against the sheriff and county attorney at court so I'm sure the county attorney and sheriff are both mad because they didn't win so that's probably why they wont return. Who do I talk to to get it back since neither one will give the stuff back?

If I understand the chair an blind were left behind when you were trying to recover the wounded deer, not a subsequent trespass. I would talk to the clerk of the judge that rendered the decision or the judge themselve. Not a lawyer, thank God, but seems pretty straight forward.

You should get them back, but Eric is right. If you push it I am sure you can get it back but you may get more grief than it is worth.

You should get them back, but Eric is right. If you push it I am sure you can get it back but you may get more grief than it is worth. Document the days and events that take place don't think the Judge and Sheriff are buds that is often not the way it is. If you were found not guilty then you should not give up anything or be required to eat a crap sandwich. If you feel hassled in the future then go to the States Attorney General with the info you have gathered or look into legal action against the County that is who signs his checks.

But how do I do that when i have to go threw the clerk of court and she is the sheriff's wife. Basically I have no one to go to.

Didn't find the deer but heard one was found in the area a few weeks ago. The sheriff doesn't like me before this happened. I never been in trouble with them before except for a couple tickets over the years. My dad was a police officer and police chief in this county for 30 years before he retired about 10 years ago. The sheriff was hired years back by my dad and they never got along and the sheriff was hired back by my dad a couple times when he never should have for certain reasons then he became a deputy and eventually the sheriff.Yes I know they will be after me but honestly I don't really care because I know why they would be doing it. I talked to the sheriff a couple days after I got the ticket and all he said was bring your witnesses to court and didn't want to hear what I had to say. I called him a few choice names and as I was walking out the door he said "by the way the dnr is watching you" I talked to the game warden who I know well and he said he's not watching me which I believe. So it's a long going thing with this sheriff. I know the roll up blind probably 36" long and rolls up to about the size of a can and a 3 legged chair even smaller is probably only $50 or so but that's not the point.

Am I the only one that thinks there is more to this story? Why would you not ask b4 you trespassed? And you knew the state land was no hunting but carried your weapon and gear in there anyway.
You should think things thru more carefully during the rest of your life or you are gonna have some rough situations to get out of...and you might be found guilty....dang!
And you admitted to the violation but were found not guilty? You were totally in the wrong...suck it up Buttercup!
Oh..and to answer your question... "Any lawyers?"...Hope you find one...your gonna need one in the future with that kind of decision making skills...

Unarmed retrieval onto private land is what I got out of it we have that here for small game but not for big game! If you leave your weapon on public then get your game it's not trespassing then.
