Per the Montana regs you need to provide written notice if a ground set is within 1000 feet of a dwelling. Anyone have any experience in this? What do you include in this notice (i.e. personal info I would assume) but do you have to offer so much advance notice? With all the anti's around where I'm at I want to make sure I'm going above and beyond. Thanks

Don't read too much into it.There is no stipulation about advance notice.As always,asking a warden may be best.

Personally,I prefer to stay further back and not deal with it or any other problems.

Thanks Taximan. I would also prefer. I was granted permission to go trap some problem fox in the area, but that would mean about 10 written notices according to this 1000 foot buffer! I think I'll avoid that situation. Just hard to avoid anyone at all where I'm at unfortunately.

I don't remember that reg when I was there, but......DNRC required you to post written notice at access points when trapping on school land. I had a bunch of 8.5 x 11 printed off and laminated ("NOTICE Traps in Use Proceed With Caution"). PM me and I'll mail you some if that would help.

If that (1000') is a reg. for public land or required by the land owner, I can totally understand that. But should I give permission to someone on my own land and a neighbor's dwelling is w/i the 1000 ft. limit and people read the reg that the trapper needs to notify him,,,, I would challenge that in court as unconstitutional with my state private land ownership rights. Really there are a lot of well meaning regs. put into wildlife bills that are totally unconstitutional when portrayed in court. Several here in our state exist but unless it is challenged (by a sharp attorney) in a court or case law (previous outcomes) supports the reg, people shrug their shoulders and pay a fine (poor attorney representation) and go on. This type of regulation (may not be the case here) is usually passed as a result of a complaint to a state representative and it gets appeased by some legislation or the regulating agency incorporating restrictions to answer a constituent's concern. These "regs" are written by an office rep and reviewed by a law clerk or an assistant Attorney General (at best), usually for its "enforce-ability" and not its constitutionality. Whether it infringes on landowner's rights is rarely reviewed (if ever). My own thoughts in these times of lower fur prices are to have private wildlife groups (that have some good attorney members) review any existing regs along with pending legislation for constitutionality. Not talking about the wolf or Yellowstone or any of the "big fish stories" that people want a big name for themselves. Bite off something the local Association can "chew" and just tweak some of the older "on the books guidelines" that were passed (probably in haste to to appease someone) that may be hampering modern fur harvesting procedures. As a note, our school land (Bureau of Education Lands and Funds) is leased for 7 year contracts and you would need the renter's permission to set foot on that land or face a trespass charge, hence a warning trap sign is mute. Perhaps since the Montana folks are fresh off the vote they want to rest awhile which is understandable......... My take ---the mike

If the fox are doing damage the landowner may be able to get a damage permit to trap them from FWP then you wouldn't have to give notice.

Sorry, Cage traps!!!!!!, but if you put live trap in your search it will bring up cage traps! Look up definition of live trap this is what it says

Fox are unprotected.There are no damage permits.1000 feet is 1000 feet,no matter how you slice it.This law has been on the books for a long time,maybe 20 years or more.I'm not sure if cages matter but I doubt it.

Just print off form letter and hand them out no big deal
Once you do that 1000ft. Distance means nothing legally.
There is common decenance although.
My advice do not engage with people, hand letter out be polite and move on.
Stay as far as you can and still get the job done move on fast.
If you have to be there.
Montana 17 cage traps your version of live trap legal or other wise is a touchy subject material. Not needed or welcomed for most of the trapping that take place this time of year in Montana.

Call the game warden in your district tonight. I have been able to print out copies, and simply sign them. Name ,number and address. I personally wouldn't mess with this job. I have used "banana bread black" bananas to live trap reds right here in Montana.
