Whose authority does the NG fall under, the governor or the president?

Governor, unless federalized.

If Biden federalizes the Texas guard the Texas Adjudgent General has a call to make regarding his oath and loyalty.

Detaining them is what we've been doing for years. But there is so many now, that there is nowhere to put them, house them, etc. So, they ship them to ya'll.

Biden should be in prison for treason against American sovereignty. This is what happens when fools run the place.

If all the BP agents think Abbott is right and the Biden is wrong, then they can easily stop following orders.

For you military guys, where does following orders and integrity meet? Is it OK to follow orders that you know in your heart are wrong and damaging to people?

I think Abbott needs to force a confrontation. I hope he does.

The Biden administration is evil and wicked and must be confronted before we lose this entire country. Crazy, but I guess that is the definition of anarchy.

Hard call there Chancey.

First is an absolute oath to defend the Constitution, first priority.

However, the uniform does not make one a Constitutional authority or judge.

Second to obey the LAWFUL orders of those appointed over you.

Again, the uniform does not make one a lawyer or expert on the law.

Those two parts of the oath require a duty to weigh each order given against the standard set.

If in conflict and you honestly and morally believe an order to be unlawful then you are duty bound to not follow it.

However, you had better be correct and able to prove it.

There are options, you may ask for clarification have it put into writing if time permits and place an objection stating why you believe the order to be unlawful. But again in the heat of the moment you had better be right.

An officer has the right to resign rather than carry out an unlawful order, enlisted does not. Both should expect to be taken into custody.

And if you do indeed carry out an unlawful order, knowingly or not, expect to be fully prosecuted. Just following orders is not a defense.

Then, he should defend the border and make Mexico deal with them. They are not our problem and and Mexico let them in. Let Mexico deal with them. If we can defend Ukraine's border, then surely we can keep a bunch of illegals from crossing a small river from Mexico into Texas.

If the Feds come and try to stop them, then their needs to be a confrontation. Problem is, all the governments are paid off. Local, State, and Federal. They are making money off this fiasco at our expense. Evil SOBS.

It's not that hard, is it?

Thanks Warrior. They are in a tight spot for sure then. Seems laws these day are at the whim of the government.

Yes, they should quit. They would NOT be leaving the border wide open since Texas National Guard is standing right there ready to take over!

Ooops, somehow I posted that twice.

But why do you find that not to be a good idea?

That's brilliant. And what happens when Biden tells the National Guard to stand down?

The national guard has the additional burden of an oath to their state constitution so add another moral conflict.

Best case for the rank and file the state adjudgent general declares the federal power to be in violation of the Constitution freeing them to serve the state and not accept being federalized but to the best of my knowledge that has never been done. It would be tantamount to seccession.

You don't want a confrontation between the BP and NG. That's playing right into Biden's hands.

Well I don't rightly know. But I hope that people that swore an oath to protect this country from invasion would ignore an unlawful order from the President?
