You guys ( and WW) remember a few days ago we were discussing pre-baiting and the legality of it. Well today I ran the question past Bearpaw and he said no problem. he also said that the law is designed to ensure public safety as well as to prevent folks from baiting waterfowl.

Gulo: would you agree that there is a legal distiction between pre-baiting sets and feeding wildlife ?

I remember, and that's interesting. Where is the line drawn at feeding and baiting? I would guess that you can only bait at certain times of year maybe?

Here's another question, what if you have a compost pile that you throw food waste into? and a critter feeds from it? What would that be considered, incidental?

And White, no worries at including me with the 'guys'...lol

Distinction between pre-baiting and wildlife feeding? I would certainly think so, but each FWP officer is different. They have "discretionary authority" that the practical ones use constantly, while you have "by-the-bookers", which could get sticky. I suspect any reasonable judge (are those mutually-exclusive terms?) would throw it out of court.

On the other hand...

Unfortunately our new brown shirt falls outside the realm of "practical"

Pre-baiting could be considered trapping during a closed season if you consider the following: AS 16.05.940 defines trapping as “taking” furbearers. The same statute defines “take” as “taking, pursuing, hunting, fishing, trapping or in any manner disturbing ... game.”

I wouldn't buy this opinion for a minute. It may qualify as "feeding animals" but I sure don't see it as "taking". That's a real stretch. Notice he says nothing about doing it during an open season. Theoretically, by his reasoning, you could do this during an open season but never set the trap. Are you still "taking" an animal under those circumstances ? Do you have to have them sealed?

I have to admit the guy immediately qualified as a fool in my book. Choosing to walk 5 miles without trying to dry your clothes strikes me as being judgementally challenged. Consequently, Whatever else he says is questionable in my mind. But that's just me.

Dwight Eisenhower said "it's better to have no law, than a bad law". Now I have all the respect in the world for LEO's but I have a corollary to Eisenhower's statement. "No trooper is better than a dumb trooper". Just my opinion, and I could be all wrong.

My musings on the brown shirts...

You get a good one in your district, one that's got the best interest of the resource in mind, do what you can to keep the guy (or gal) around. Take 'em on your line. Tip a cup or two of coffee with 'em. As I've opined before, every profession's got its good 'uns and it's slinkies. If you've got a good brown shirt, be thankful. They can be mighty helpful in a pinch.

On the other hand, I agree completely with white17. A bum one can become a lot like carburetor ice in a SuperCub. Without a little heat, it'll get you sooner or later.
