Hi. If someone writes a story here for purpose of editor feed back and general help with grammar, suggestions, etc. Can that story be poached and used by anyone to publish? Or is the writing the sole property of the author?

No, you don't lose your copyright by posting a work here.
Copyright is a very complex subject, but I think there are three general things writers should know:
1. Copyright is created automatically, by operation of law (US Copyright Act and foreign treaties), as soon as a work is fixed in any tangible medium of expression. This means as soon as the words or images are written on paper, or typed and saved to a computer hard disk, for instance. You have a copyright in your grocery list.
2. It isn't required to post a copyright notice to preserve your copyright, but is a good idea. A notice puts the world on notice that you do intend to assert your copyright, and prevents someone from asserting an innocent infringement defense. An effective notice looks like this:
Copyright by [your name] 2007. All rights reserved.
I intend to use such a notice on my own work shown here.
3. It is not required that you register your work with the US Copyright Office; but such registration IS a pre-condition for filing suit in federal court for wrongful infringement. Registration also gives a presumption of authorship (if authorship is later disputed).
Be aware that Paul Dobbins has a copyright of his own in this site's format. SO THE COPYING OF ANY WORK FROM HERE REQUIRES PERMISSION FROM BOTH THE AUTHOR AND MR. DOBBINS.

#1 Did I just break copyright laws by copy and pasting that without James and Pauls permission?
#2 According to this statement. If one posts a story here, would he need to have Pauls written permission to later send it to a publisher?
I'm not trying to be smart or anything, just not wanting to scramble the copyright black helocopters is all. Others may have these concerns but are afraid to ask. Thanks.
1. You didn't violate my copyright by re-posting my words because of the fair use doctrine, which allows limited copying of a work for purpose of criticism, comment, or similar. But fair use is far too complex and uncertain a doctrine to rely on, so the wise thing to do is to seek permission, if you want to copy something here for use elsewhere.
2. No. Not unless you're trying to print out the story from here, which would result in your story showing up in Paul's format. But that would be a foolish way to submit a story to an editor. You should follow accepted manuscript format for submitting work to editors.
Incidentally, Paul's old trapperman site also had a forum for members to post their literary efforts ("Trappers Tales"), which I don't recall your having a problem with.
The only difference here is that we're trying to allow for comments and discussions of such works, to encourage their improvement.

You are comparing apples to oranges. The "Trapper Tales" segment of the old website was under editorial control. An author could not self publish in Trapper Tales. Mr. Dobbins was the sole arbiter of what went in there. I don't know how much, if any, editing he did. But I'm sure if there were inappropriate passages, he would have or did take them out, for example.
This here is a wild west show. All you have to do here is decide that YOU wanna see the thing in print then -- push that button and away we go! These are not submissions. This is self publishing as it's most basic and base level.
Trapper Tales?? It ain't even the same thing, bubba.
