Although the fella broke no laws. He showed very poor judgement with his actions due to the recent movie theater shooting. So, if anything, he is guilty of being an Idiot.

Nobody said anything about concealed carry. The question is, did the guy show good judgement by walking into a theater in Colorado with a firearm in a holster in plain view just days after some nut shot 70 people in a movie theater. that's a no brainer, when he even had a concealed carry permit. he should have used it unless he was looking for trouble. could've picked a better time and place to open carry.

Leaving a loud Fart in Church or a "silent killer" in a crowded elevator is not illegal but it IS a display of poor judgement. This man's judgement was just as poor.

Blueridge, your right I misread what you had posted. the theater owner appears to be pro second amendment and intentionally does not post his business. Time will tell how all this plays out. I am wondering if the theater goer who called in and caused all the fuss will be looking at charges? I doubt it, but how mush different is causing a panic in this case vs yelling fire in a crowded theater? Just not sure how it will run No it is different than yelling "fire" which is against the law if there is no fire - or SHARK!! on a crowded beach if there is no shark (hard to prove huh!) The person who called him in for carrying was just concerned seeing an individual with a firearm in a theater shortly after a man opencarrying in a theater killed 70 folks? The person who called LEO on him did nothing wrong and was acually exercising better judgement then the man with the gun exercised. Hence the fact you can OC unless you make someone nervous, then you will be asked to conceal or remove. Arresting the man was too far and I hope he goes after the LEO who arrested him - far answers as the LEO made poor call as well - but then I default as I was not there, who knows the man may have mouthed off to the officer? Who knows but there are fine lines to carrying in public and exercising good judgement when you carry i.e.... nut just kills 70 people in CO with a gun in a movie theater and then a few days later you decide to carry (OC) in a movie theater in CO?? yes it is your right BUT is it the best idea in the world? no Chief

How long of a waiting period is enough for you to protect yourself? Does your life cease when some nutjob kills a bunch of people? The difference here is, the man was open and clear with his intention (implied) to protect himself and possibly others. Holmes walked out of a dark theater and then snuck back in, armed to the teeth to reign terror on unsuspecting people. If non gun owning people would stop assuming the worst, and panicking when they do see a legal carry situation, this would not of happened.
Someone freaked out when they saw the gun and called the police. Nothing really wrong with that, but then the cops overreacted by arresting the law abiding carrier. Something wrong with that.

MHO is that it was in very very bad taste after the shooting in Colorado .
While legal to open carry , was it necessary to put fear in everyone around him?
Was he afraid that unless he carried it in the open , that he may get shot by some nut job ?
Maybe it's just me , but I think the nut job would take out someone open carrying first .
But I don't know .............. how others think !

Lot of arm chair experts ,who gives a ,not to be fringed on ,may not be the way I'd do it but doesnt mean its wrong ,when proper person is in proper carry ,
and if more had broken the the law then could of been a lot of differant serneos possible
bottom line is qiut being the good sheople ,

There is some liberal brainwashing coming out here. There is nothing wrong with open carry. We do not have to hide our rights.
If the pansy PC crowd don't like open carry who gives a darn. They can stay inside and play video games.They don't like guns anyway. We need more exposure to firearms for society. They should be mainstream not hidden like a dirty little secret.
Someone above posted the city ordinance that forbids what he did. I know each state is different but in SD local government is not allowed to make restrictions on firearms. It is in the SD Constitution.
The City of Sioux Falls just repealed their laws which said you could not carry on city property- they were illegal and not enforceable.

I'm betting that even if the DA drops the charges the guy's problems aren't over. The movie theater owner will probably sue him for thousands in lost revenue, and there's a good chance the owner will win. This has happened before (in reference to false arrests and cops getting antsy over OC)...he'll sue Thornton and win easily. The theater has NOTHING to stand on so long as the doors weren't posted. Go debate with someone else... Anybody can sue over anything. Unless the judge rules it frivolous, which probably won't happen, it can go before a jury. Then it is a question of whether 9 out of 12 jurors decide the guy's bad judgement cost the theater money.

Hey Buck, there is a poll asking that same question and 72% said yes to it being in good judgement. So your in the minority here. Doesn't matter what a poll says. What matters is what a jury in a lawsuit says.

I dont understand open carry, purely from a tactics standpoint.
In my mind, open carry makes you the first target to take out when a bad person comes to do what they do. Furthermore, if the bad guys weapon is concealed, it gives him EVERY advantage over you.
Id much rather have my firearm concealed. Concealed, you appear at first glance to be just another unarmed victim in which case, you may be largely ignored. This gives you an element of surprise when you take the offensive, and allows you to engage when it is most opportune for you.

Boone I guess if a regular everyday robber comes into a gas station to rob it and sees a guy has a gun in there he might just wait till the armed citizen leaves to rob it. Or if he is doped out of his mind he might just do like you said and shoot you first.
