Im just looking for someone to check snares every day . Ill split the money with them . I have one guy sent me a pm , just need to talk to him first . He's looking to learn the trade so it's good for him . And me I'm just to bizzy trapping squirrels and stuff . Running these snares just takes to much time . Might try the collarum to . I just bought one but need to get a special permit to use it . The job about 1 square mile the people took up a collection after the coyotes attacked a dog to death .

You might want to call a local company that already has the liability insurance and workers comp established. Otherwise, you might have a risk. Glad to hear you are busy!

So is this "snare checker" going to be an employee or a contractor? As you probably already know Pesky there are significant ramifications and potential legal/tax nightmares any way you proceed with this. But I'm sure you have already did a risk assessment and discussed this with your attorney.

Then there is the aspect of paying to train potential competitors. Back when I used to give on-the-line instructions for people interested in getting into the adc industry I charged a hefty fee and wouldn't take any students within a certain number of miles as a means of protecting myself. Turned out that my mileage as a safety net wasn't near far enough. Had a student move into one of my better paying areas, contact my customers, under bid me, and use my own methods against me. Cost me more than $50,000 in five years. And this guy had to drive 50 miles one way to get into that area. Lesson learned. Stopped giving paid instructions. Will no longer even help a buddy out. But that is another story that also turned into a nightmare and cost me untold thousands of dollars over the years.

Exactly. Except, if the person is using Pesky's snares (equipment)....he would be an employee....and entitled to unemployment benefits.

I doubt checking snares a few hours every morning for a week or two would qualify one for unemployment insurance,not up on Michigan laws though.
I doubt using a guys tools would qualify one as an employee,construction companies sub work out all the time to smaller companies and they use the other companies tools on site,that don't make them an employee,just a sub contractor.
If you have enough work hire someone part time that wants to learn,make them sign something that says if they quit or leave your employment that they can't start a similar business within the area you operate.I worked for a cleaning company,which was a franchise and we signed something like that,in fact when the owner decided to sell he had to sign a similar document with the buyer stating he wouldn't turn around and re-open a similar business for at least 10 years in his old franchise area.There are things you can do to protect yourself if that is a concern to you...
K9,that sucks.I know a lot of guys that instruct won't take anyone within 300-500 miles of them.Heck,O'Gorman won't even sell his lures and baits to anyone to close to him.LOL

You can sub work out. However, the subcontractor must provide the tools. The hiring contractor can not dictate how a job should be done. In this case, the untraind person...without the tools....would be an employee. Look at the irs rules for the difference between a contractor and employee. Or, look at a recent wct mag, that had an article.

Just because people do not follow the rules, does not make it right. There is a big iniative to crack down on people misclassifying employees as contractors. Do google search.

What happens when you say that someone off the street is a contractor, then he gets injured? Maybe it is a freak auto accident on the way to the job site....or the animal bites him? Attorneys will look and determine if the person was misclassified. In this example, there would not be any workers comp policy.....so who is getting sued?

The easy solution, sub the work out to an established business with all the tools and insurance set up. Piece of cake.

That makes sense then...

It is kind of a shame though that we have come to the point where you can't hire someone for a few days without worrying about all the bs.I used to work several different farms during the summers when I was a teenager,just got payed cash for the day,no paperwork to sign ect.An honest wage for an honest days work...

That is a bummer. I wish that I could do the same thing...but it is definately not worth the risk. Ultimately, you have to decide to be a one man show....or grow to a point to hire people.

Thanks DaveK for taking that for me. I've been off this site for a few days. CLT, I remember the days of working on farms for cash as well, but those days are long gone due to politicians. If Pesky doesn't watch his butt he could very well be in for some serious financial woes if something goes wrong.
