Judge allows wild horse roundup near Susanville; foes to appeal

A controversial roundup of about 2,300 wild horses and burros near
Susanville next week can go forward as planned, a federal judge in
Sacramento has ruled.

U.S. District Judge Morrison C. England Jr. on Thursday denied a
temporary restraining order and preliminary injunction that would have
halted the roundup by the federal Bureau of Land Management.

England said he was not convinced that the BLM's actions would cause
"irreparable harm" as argued by attorneys for animal advocates,
including a UC Davis ecologist who researches the horses.

Lawyers representing the advocates said they would quickly file an
appeal. "We will ask the 9th Circuit to step in and correct the errors
that the judge made," said attorney Stuart Gross.

The roundup is scheduled to begin Monday.

The BLM, which is charged with keeping the population of wild horses
in check and managing their environment, contends that there are too
many of the animals on the sprawling Twin Peaks rangeland northeast of
Susanville. The situation threatens the animals themselves as well as
other wildlife and vegetation, they argue.

Opponents "want the BLM to sit idly by and wait until the situation
gets dire" before taking action to control the population, U.S.
Department of Justice attorney Erik E. Petersen told the judge. "BLM
has a statutory obligation to achieve and maintain an ecological
balance."

But critics charge that the BLM's tactics are outdated, unscientific
and harmful to the animals.

Plaintiffs lawyers argued in court Thursday that the Twin Peaks
roundup is illegal because the government has failed to prove that the
wild horses and burros are overpopulated or have harmed the
environment.

They said the BLM's plan to chase the animals with helicopters, ship
them to holding facilities in the Midwest and return some of them to
the wild would destroy the "social fabric" of the herd. It also would
prevent scientists and the public from seeing the animals in their
natural surroundings, they said.

They also predicted that some horses would die as a result of the
roundup, pointing to the deaths of at least seven mustangs herded in
Nevada last month.

"It is clear that some of these beautiful, regal animals that are
supposed to be protected by Congress will be killed in this illegal
roundup," said environmental attorney Rachel Fazio.

More than 2,000 people have written letters in opposition to the
roundup, Fazio said. "The public has a great interest in what happens
in this case."

Petersen and Department of Justice attorney Ayako Sato said that only
"excess" horses will be permanently removed from the area, and that
BLM would make sure that the rounded-up animals will have proper food
and water to stave off life-threatening dehydration.

Some of the horses that remain on the land will breed and "we'll have
to do another gather in three or four years," Sako said.

The BLM wants to conduct the summertime "gather" to avoid doing it
later in the fall, when it would conflict with deer hunting season.

Given all of the arguments and the BLM's time restrictions, England
ruled that the roundup can go forward.

"The balance of equities does not tip in favor of the plaintiffs," he said.
