How do you decide which is the best business type? I know that there is s,c,llc,sole, and parter. How do you pick the correct one. I do some guiding, adc, and trap supply. I want to combine it all into one. Such as A-1 ADC, Trap Supply, and Guide Service. How do I pick which type I need. What do all you guys use. Thanks WTA

An attorney may be able to give you the best answer or a tax consultant.You can be a sole proprietor and elect to take any other option for tax and private property protection that will fit your business endeavours the best.

I am personally an LLC. As Bob said it's best to ask an attorney. I think too, that talking privately with different WCO's may give you some insight that may be overlooked in an attorneys office. When I was first starting out, I was just a sole proprietor and that was fine for the style I was living. Today, I've grown quite a lot, so things changed. I've got more to lose now. I didn't recall Bob saying which he was and quite possibly it doesn't matter. But I'm a LLC co. , so there's one vote. \:\)

LLC is the way to go if your serious about this. At least that way if something really bad happens, they cant touch your personal property if you have to pay out on a lawsuit.

Regardless of which type entity you operate as, having the correct (use your judgement here) amount of business liability insurance coverage is universally important. One thing to remember is that if you are brought into a legal action, you will incur attorney fees even if you prevail on the action. The liability insurance coverage should cover both the legal costs, they generally name the legal team to defend your case, and the down side if they choose to settle or you lose. One thing to keep in mind is that over a minimum amount of coverage, additional coverage can be purchased much cheaper--consult with a competant attorney, CPA, and insurance broker. Best wishes!

I am not what most would consider a profectionist but when it comes to creating my business I want everything to be as perfect as possible. I would hate to get business cards, car magnets, bumper stickers, shirts and hats and other publicity stuff and then have the need to put LLC or INC or something like that on it if I need to do one of them. I have most of the stuff mentioned above created, proofed and on hold until I decide which one to go with if any. LLC's are $200 dollars a year plus the $400-$500 initial set-up fee. Thats a bunch of $$$$ to be putting out there if you don't really need it. I do have assets that someone would want. I have rental propertys, land, cars, boats exc that I assume someone could take if they wanted to sue me.
I am sure that I want to, at the least, make this a part time business. Heck, it already is a part time job and I aint even got a thing printed. Its been word of mouth so far from the other satisfied customers. I want to do it right and not get in any trouble with the IRS or any other folks.

So if you have a business set up please tell us which one you chose and why. We sure would appreciate it from some of you Pro's out there.

Here is some good advice! Looks like you can afford an attorney and get some insurance.

That sounds like the best advice that you will get.

EDIT: Hire an attorney that specializes in "Business Law".

In addition to considering the business type those who are first starting out should give thorough consideration to the name they choose for their business. Business names should be registered with your Secretary of State's office. The Secretary of State will tell you if that busienss name is available in your state or if someone alredy has that name registered.

But it is not your Secretary of State's job to tell you if the name you have selected is protected by a Federal trademark. You should also check with the U.S. Patent & Trademark Office to determine if a Federal trademark has been placed on the name you have chosen. Unfortunately the USPTO online data base is not current. It is best to use the services of an attorney to check for up to date trademark registrations.

The services of an attorney, whether for a trademark search or choosing a business type or for general advice, should be considered part of the initial investment in your business and not an expense. The real expense occurs weeks, months or years later when you have to correct the even more expensive problems caused when you cut corners setting up your business.

Very good point about name searches. Its very fustrating waiting on choice 1,2 or 3. But checking it out first is cheaper than changing it later
